Terms of Service

1. Acceptance of Terms
By accessing or using SureMile services, including the SureMile mobile application and getsuremile.com website ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
SureMile provides AI-powered fleet management tools including rate confirmation processing, GPS trip tracking, IFTA mileage reporting, invoice generation, and fleet management for commercial trucking operations.
3. User Accounts
You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your account credentials. One account per phone number is permitted. You must provide accurate information during registration.
4. Acceptable Use
You agree not to:
- Submit fraudulent or falsified documents
- Reverse engineer or attempt to extract source code
- Use the Service for any unlawful purpose
- Interfere with or disrupt the Service
- Share your account credentials with unauthorized users
5. Subscription & Billing (Auto-Renewable Subscriptions)
SureMile offers a free plan and the following paid auto-renewable subscription plans:
- SureMile Silver — monthly subscription
- SureMile Gold — monthly subscription
- SureMile Platinum — monthly subscription
Pricing, subscription length, and the name of each plan are displayed inside the app on the purchase screen before you confirm any payment.
Payment: Payment will be charged to your Apple ID account at confirmation of purchase.
Auto-renewal: Your subscription automatically renews at the end of each billing period unless auto-renewal is turned off at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription price.
Managing and cancelling: You can manage your subscription and turn off auto-renewal in your Apple ID Account Settings on your device at any time after purchase. Cancelling a subscription does not provide a refund for the current billing period; you will continue to have access to the subscription until the end of the period you already paid for.
Free trials: If a subscription includes a free introductory period and you purchase the subscription, any unused portion of the free period will be forfeited when the subscription is activated.
Refunds: All refunds for subscriptions purchased through the App Store are handled by Apple under Apple's published refund policy. Requests may be submitted at reportaproblem.apple.com.
Price changes: If we change the subscription price, you will be notified in advance and given the opportunity to cancel before the new price takes effect.
6. Intellectual Property
The Service, including all software, designs, and content, is owned by SureMile and protected by intellectual property laws. You retain ownership of all data you upload to the Service, including documents, load information, and trip data.
7. Data & Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in our Privacy Policy.
8. Disclaimers
The Service is provided "as is" without warranties of any kind. IFTA mileage calculations and tax reports are provided as tools to assist with compliance — you should verify all calculations with a qualified tax professional before filing. SureMile is not a tax advisory service.
9. Navigation, Maps & Location Disclaimer
The Service may display maps, routes, driving directions, estimated travel times, location coordinates, and points of interest such as truck stops, fuel stations, and weigh stations. SureMile expressly disclaims any and all warranties — express or implied — relating to the accuracy, completeness, currency, or suitability of maps, content, road conditions, height, weight, length, or hazardous-material restrictions, driving directions, or navigation routes presented or displayed in or by the Service.
Location data, whether collected directly by the Service or supplied by third-party providers, may be inaccurate, delayed, or unavailable. SureMile disclaims all warranties related to location data and location-based services.
You are solely responsible for the safe operation of your vehicle and for independently verifying that any route is legal, safe, and appropriate for your equipment, cargo, and the conditions of travel. You hereby agree that you will not use the app while driving and will abide by the laws under the jurisdiction you are in. SureMile shall have no liability of any kind for fines, violations, citations, accidents, property damage, personal injury, or death arising from use of the Service while driving or from reliance on routing, navigation, location, or point-of-interest information provided by the Service.
10. Limitation of Liability
To the maximum extent permitted by law, SureMile shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the twelve months preceding the claim.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law provisions.
12. Termination & Account Deletion
We may terminate or suspend your account at any time for violations of these Terms. Upon termination, your right to use the Service ceases immediately.
You may delete your account at any time from within the app (Profile screen → Delete Account). When you delete your account, you are signed out and your account is deactivated so that you can no longer log in. Records that your organization is required to retain for regulatory or compliance reasons — including trip records used for IFTA fuel-tax reporting, DOT records, load history, documents, and invoices — may be retained by your organization in accordance with applicable law. For questions about organizational retention, contact the owner of your organization account.
13. Apple App Store — Additional Terms
The following provisions apply to your use of the SureMile mobile application obtained from the Apple App Store and supplement the other Sections of these Terms. In the event of any conflict between this Section 13 and any other provision of these Terms with respect to the application obtained from the Apple App Store, this Section 13 shall control.
13.1 Acknowledgement. You acknowledge that these Terms are concluded between you and SureMile only, and not with Apple Inc. ("Apple"). SureMile, not Apple, is solely responsible for the SureMile application and its content. To the extent these Terms provide for usage rules for the application that are less restrictive than or in conflict with the Apple Media Services Terms and Conditions, the more restrictive terms shall apply.
13.2 Scope of License. The license granted to you for the application is a limited, non-transferable license to use the application on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the application may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
13.3 Maintenance and Support. SureMile is solely responsible for providing any maintenance and support services with respect to the application, as specified in these Terms or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the application.
13.4 Warranty. SureMile is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the application to you (if any); to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the application. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be SureMile's sole responsibility.
13.5 Product Claims. SureMile, not Apple, is responsible for addressing any claims by you or any third party relating to the application or your possession and use of the application, including, but not limited to: (i) product liability claims; (ii) any claim that the application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
13.6 Intellectual Property Rights. In the event of any third-party claim that the application or your possession and use of the application infringes that third party's intellectual property rights, SureMile, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
13.7 Legal Compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

13.9 Third-Party Terms of Agreement. You must comply with applicable third-party terms of agreement when using the application.
13.10 Third-Party Beneficiary. You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary of these Terms.
